DMCA & Copyright Policy

1. Introduction

SmartSVG.ai (“SmartSVG.ai”, “we”, “us”, or “our”) respects the intellectual property rights of others and expects users of the Service to do the same.

Although SmartSVG.ai operates from Canada, we voluntarily comply with the notice-and-takedown framework established under the Digital Millennium Copyright Act (“DMCA”) in order to provide a structured mechanism for reporting alleged copyright infringement.

This Copyright Policy applies to all users worldwide.

2. User Responsibility

Users of SmartSVG.ai are solely responsible for the images and content they upload, convert, download, or distribute through the Service.

By uploading content, you represent and warrant that:

• You own the copyright in the content; or
• You have obtained all necessary permissions, licenses, or authorizations from the copyright owner; and
• Your upload and use of the content does not infringe any third-party rights.

SmartSVG.ai does not pre-screen, monitor, or verify ownership of user-uploaded content.

3. Notice of Alleged Copyright Infringement

If you believe that content made available through SmartSVG.ai infringes your copyright, you may submit a written notification containing the following information:

• Your full legal name and contact information (email and mailing address);
• A description of the copyrighted work claimed to have been infringed;
• A description of the allegedly infringing material and sufficient information to locate it (such as URL or account details);
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner;
• Your physical or electronic signature.

4. Counter-Notification

If you believe that content was removed in error or misidentification, you may submit a counter-notification including:

• Your name and contact information;
• Identification of the material removed and its previous location;
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
• A statement consenting to the jurisdiction of the courts in Canada;
• Your physical or electronic signature.

Upon receipt of a valid counter-notification, SmartSVG.ai may restore the content unless the original complainant files a court action within the legally required period.

5. Repeat Infringer Policy

SmartSVG.ai reserves the right to suspend or permanently terminate accounts of users who are determined to be repeat infringers.

We may also terminate accounts at our sole discretion where there is clear evidence of willful infringement.

6. Limitation of Liability

SmartSVG.ai acts solely as a neutral technology provider. We do not host public galleries, curate user content, or actively distribute user-generated materials.

To the fullest extent permitted by law, SmartSVG.ai shall not be liable for copyright infringement committed by users of the Service.
